How FlyHouse collects, uses, and discloses personal data — and the choices you have over it.

This Privacy Statement describes how FlyHouse Technology, LLC, including its affiliates and subsidiaries (collectively, "FlyHouse" and also referred to as our, us, and we) collects, uses and discloses personal data, as well as any choices you have with respect to this personal data.

What does this Privacy Statement apply to?

This Privacy Statement applies to FlyHouse's charter booking and bidding tools and platform, including the associated FlyHouse mobile and desktop applications (the "Apps"), goflyhouse.com and other FlyHouse websites (the "Sites") and other online tools or interactions (collectively, along with the Apps and Sites, the "Services") you may have with FlyHouse, including the processing of any messages, files, video or audio recordings, prompts, payments or other information submitted through our Services.

The individual or entity ("User") that entered into the Terms of Use, and any service-specific terms, such as the Charter Terms and Conditions (together, the "User Agreement") controls its instance of the Services and any associated User information.

What data do we collect?

FlyHouse collects the following information:

  • Identifiers or Identity Data such as a full name, alias, postal address, unique personal identifier (e.g. cookies), date of birth, online identifier Internet Protocol address, passport / ID data (number, expiry, country of issuance, nationality) or other similar identifiers.
  • Contact Data including billing address, delivery address, email address and telephone numbers.
  • Commercial Information, including requested price quotes, services purchased or other purchasing or consuming histories or tendencies, as well as Financial Data (bank account and payment card details) and Transaction Data (details about payments to and from you and other details of services you have purchased from us).
  • Network Activity Information, including, but not limited to Technical Data (your login data, browser type and version, browsing history, search history, time zone setting and location, browser plug-in types and versions, operating system and Platform, and other technology on the devices you use to access our Platforms), and information regarding your interaction with our Apps (Usage Data).
  • Geolocation data (country, state or city).
  • Audio (e.g. call records) and Electronic (e.g. email threads) information.
  • Inferences drawn from any of the personal information collected by us, including Profile Data (your preferences, characteristics, psychological trends, behavior, attitudes, intelligence, feedback and survey responses) and Marketing Data (your preferences in receiving marketing from us and our partners and your communication preferences).

We may also collect, utilize, and share Aggregated Data — statistical or demographic insights — for any purpose. Aggregated Data is derived from your personal information but does not directly or indirectly identify you. If we combine Aggregated Data with personal information that allows for your identification, the combined information will be treated as personal information.

How do we collect your data?

You directly provide FlyHouse with most of the data we collect. For example, we receive personal information from you when you:

  • Register for an account;
  • Request a charter flight;
  • Submit passenger details for a charter flight;
  • Enter a sweepstakes or contest sponsored by us or one of our partners;
  • Sign up for special offers from selected third parties;
  • Participate in a survey;
  • Send us an email message;
  • Submit your credit card or other payment information when ordering and purchasing Services.

We also receive data through automated means such as cookies and other tracking technologies. FlyHouse employs cookies, web beacons, and other automated technologies to personalize your experience, manage business operations, diagnose technical issues, and acquire insights into our clientele.

How will we use your data?

FlyHouse will only collect your personal data if at least one of the following criteria are met:

  • Consent — you have explicitly agreed to our collection or use of your personal information.
  • Legal Obligation — we are legally required to collect or use your personal information.
  • Performance of a Contract — your information is essential to deliver services you have requested.
  • Legitimate interest — we use your data to pursue legitimate business interests in a manner that does not materially impact your rights.

FlyHouse uses your personal information for: bookings and platform services; customer support and communications; marketing activities; market analysis, research, and training; security and legal compliance.

Do we share your data with or sell your data to third parties?

FlyHouse does not sell your personal information in exchange for money. With your explicit consent, FlyHouse shares various Identifiers and Network Activity Information with third-party analytics providers — such as Google and Meta — to help us understand how users engage with our Services. These providers may then use this data for cross-context behavioral advertising. You can withdraw your consent at any time.

Outside of these limited circumstances, FlyHouse only shares your personal information with third-party service providers for the specific business purposes outlined in this Privacy Statement: cloud hosting and data storage providers; payment processing vendors; marketing and customer engagement platforms. These providers are contractually prohibited from using your information for any other purpose.

To facilitate your flights and comply with federal aviation regulations, certain booking information must be shared with the charter operators responsible for conducting your flights.

Cookies

Cookies are text files placed on your computer to collect standard internet log information and visitor behavior information. We use:

  • Strictly Necessary Cookies — required for our website and platforms to function. You cannot opt out of essential cookies.
  • Functional Cookies — recognize you across sessions and remember preferences (language, location).
  • Advertising — collect information about your visits, content viewed, links followed, browser, device, and IP address; some data may be shared with advertising partners with your consent.

You can set your browser not to accept cookies, though some App features may not function as a result.

How do we keep your data secure?

We implement technical, administrative, and physical measures to secure the personal information we collect. While we strive to use commercially acceptable means to protect your information, we cannot guarantee absolute security. In the event of a data security incident that may affect your rights or interests, we will promptly notify you in accordance with applicable laws and regulations.

What are your data protection rights?

If you are located in the European Economic Area or the United Kingdom, you have the rights to: access, rectification, erasure, restriction of processing, objection to processing, and data portability. Other countries — including Canada and Mexico — provide variations of these rights under their own statutes (PIPEDA, the Quebec Private Sector Act, LFPDPPP).

International data transfers

As a global business, it is sometimes necessary for us to transfer your personal information to countries other than your own — our servers are located in the United States. We take measures to comply with applicable data protection laws related to such transfers, including the EU-U.S. Data Privacy Framework, the UK Extension, and the Swiss-U.S. Data Privacy Framework, EU Standard Contractual Clauses, and transfer impact assessments.

FlyHouse flights are operated by our wholly-owned FAA/DOT air carriers (FlyHouse, AOC# 3GWA687M or Sun Air Jets, AOC# S6NA042K). All flights shall be operated by an approved direct air carrier or foreign direct air carrier that holds an Air Carrier Certificate under 14 C.F.R. § 119 (or equivalent license as a foreign air carrier under applicable foreign law), authorizing them to furnish air transportation services pursuant to 14 C.F.R. § 121, § 129 or § 135 (or equivalent license authority as a foreign air carrier under applicable foreign law), as such air carrier may be utilized or designated to charterer with prior notice. For the avoidance of doubt, when FlyHouse provides air transportation services to a charterer, they are a direct air carrier (also referred to as an “Operator”). When FlyHouse acts as an agent for the charterer, arranging services as an indirect air carrier, per 14 C.F.R. § 295, the certified FAA/DOT air carrier, or foreign equivalent, shall be disclosed.
